Official Rules for Mercy Home’s Oktoberfest 2012 Raffle

VOID WHERE PROHIBITED. All raffle tickets must be purchased or issued in the City ofChicagoor other authorized jurisdiction. The Mercy Home Oktoberfest 2012 Raffle ("Raffle") is a random drawing raffle to occur at The Berghoff Restaurant's Oktoberfest Event held at Federal Plaza on the corner of Adams and Dearborn Street, Chicago, IL to be held on or about Friday, September 14, 2012 (the "Drawing"). Participation constitutes each entrant's full and unconditional acceptance of and agreement to be bound by these Official Rules. Raffle is sponsored by Mercy Home for Boys & Girls, 1140 W. Jackson,Chicago, IL 60607("Sponsor").

Eligibility / To Enter: The Raffle is open to individuals who are at least 18 years of age. To enter, eligible entrants must purchase one or more raffle tickets for the Raffle. Tickets for the Raffle will cost twenty dollars ($20.00) per ticket or fifty dollars ($50.00) for 3 tickets. Tickets must be purchased or issued in the City ofChicago or other authorized jurisdiction through Sponsor prior to the Drawing and while supplies last. Employees of Sponsor, American Airlines, Travel Center Tours, Strategic Hotels & Resorts, and BMO Harris Bank N.A. and other persons involved in the administration of the Raffle ("Sponsor Personnel") are not eligible to enter or win.

Selection of Winners: One (1) Grand Prize winnerand one (1) Second Place winner will be randomly selected in the Drawing. Winners need not be present at the Drawing to win. Winners must acknowledge acceptance of their prize to Sponsor by September 30, 2012 or prize may be forfeited. Odds of winning depend on number of eligible entries.

Prizes:

Grand Prize

a.) Grand Prize winner will receive one (1) prize package consisting of two (2) round-trip main cabin tickets aboard American Airlines from the American Airlines or American Eagle city nearest the city of residence providing direct service to Los Angeles, California based on space availability, and a three-night stay for two people at The Ritz-Carlton Laguna Niguel Dana Point, California based on space availability. Pool/Garden view accommodations only. Space available basis, room, tax, resort fee and parking only. No ground transportation is provided. This hotel gift certificate may only be redeemed at The Ritz-Carlton, Laguna Niguel. This certificate can not be applied towards discounted room rates, packages, special promotions, or group reservations. This certificate cannot be duplicated, replaced or refunded if lost, stolen or destroyed. No cash value. Travel must be completed by September 14, 2013 or prize will be forfeited in its entirety. Approximate retail value of Grand Prize ("ARV"): $3000.00 (Actual value may vary based on airfare fluctuations and distance between departure and destination.)

b.) Air Transportation Travel Award letters(s) have no value except when redeemed in accordance with the terms and conditions in the prizeletter(s) guidelines as well as those listed on the back of the prize letter(s). Tickets are not transferable or refundable.

c.) Reservations made using prize letter(s) are subject to availability of promotional inventories and current embargoed dates. Coach must be booked in "T" class. Embargoed dates may apply.

d.) Travel Certificates provided in this agreement cannot be bartered or sold for cash, or in lieu of cash payment.

e.) Travel Certificates must be issued theAmerican Airlines Redemption Center at 1-800-727-2142. Travel agencies cannot issue Travel Certificates.

f.) Any applicable fees, taxes, surcharges, service charges, or passenger facility charges are the responsibility of the user and must be paid at the time the Travel Certificate is issued. Taxes include all federal, state, local and foreign taxes of any kind, and whether assessed for winning or otherwise coming into receipt of the Travel Certificates, or in relation to use of the Travel Certificates.

g.) Minors who are declared winners must be accompanied on all prize flights by a parent or guardian.

h.) Travel Certificates are valid for travel only on American Airlines, American Eagle Airlines, Inc., Executive Airlines, Inc. or the AmericanConnection Carrier (collectively referred to in this as "American Airlines") American Eagle and the AmericanConnection carriers are regional airlines associated with American Airlines, Inc., each of which is a wholly owned subsidiary of the parent company of American Airlines. The AmericanConnection service is operated by Chautauqua Airlines, Inc., an unaffiliated independent contractor. Travel is not valid on flights operated under a code sharing agreement with other air carriers.

i.) Travel must be via the most direct American Airlines routing. Unnecessary and circuitous routings, connecting points and/or segments are prohibited. Stopovers, except for the next connecting flight, are not permitted.

j.) American Airlines is not responsible for, and will not pay, expenses associated with transportation on other carriers, ground transportation, excess baggage charges or overnight lodging, if required.

k.) If American Airlines, for any reason, discontinues service to the selected destination before the travel date, the use must select an alternate American Airlines destination.

l.) After a Ticket has been issued from a Travel Certificate, an administrative service charge of $100.00 will be assessed for any change requiring reticketing, such as a change of origin or destination. Changes requiring reticketing must have prior approval of ticket authorizer.

m.) After a Ticket has been issued from a Travel Certificate, an administrative service charge of $25.00 will be assessed for any changes regarding a date or time. Changes requiring reticketing must have prior approval of ticket authorizer.

n.) After a Ticket has been issued from a Travel Certificate, Customer must contact theTicketRedemptionCenteror Reservations prior to flight if they plan on canceling their ticketed reservation. In the event Customer fails to contact an American Airlines representative through theTicketRedemptionCenteror Reservations, the ticket will default to a No-Show, and an administrative service charge of $50.00 (Coach Class) will be assessed to reinstate the reservation.

o.) Unused Travel Certificates may be used at a later date (valid until travel expiration date), subject to a ticket reissue fee. Travel Certificates that are not used by the expiration date of the contract will not be extended. Credit will not be given for unused Travel Certificates.

p.) Lost or stolen Travel Certificates will not be replaced.

q.) Passengers are not eligible for AADVANTAGE mileage credit or any other promotional benefit that American may offer. AADVANTAGE miles and/or stickers cannot be used to upgrade.

r.) Purchased upgrades are permitted by paying the difference between the full fare for the authorized class of service and the next class of service. Paid upgrades are only allowed for next cabin. Two cabin upgrades will not be processed. Processing of purchased upgrades will be handled when redeeming certificate throughTicketRedemptionCenterand may not be handled at airport ticket counters. Processing time is a minimum of 48 hours based on hours of operation ofTicketRedemptionCenter.

s.) Domestic travel is subject to American Airlines CONDITIONS OF CARRIAGE, as may be amended from time to time. International travel is regulated by the WARSAW CONVENTION, as amended, or the MONTREAL CONVENTION OF 1999, as applicable, and by applicable tariffs. The Conditions of Carriage and Tariffs may be found on AA.com.

First Place Prize

The First Place winner will win a five-hundred dollar ($500) BMO Harris MasterCard® courtesy of BMO Harris Bank N.A. (ARV: $500). BMO Harris Bank and BMO Harris MasterCard® are not sponsors or co-sponsors of this Raffle and is not affiliated with the sponsor. The terms and conditions governing the use of the Gift Card are included in the Card holder Agreement. Gift cards are issued by BMO Harris Bank N.A. pursuant to a license by MasterCard International Incorporated. MasterCard is a registered trademark of MasterCard International Incorporated. BMO Harris BankSM is a trade name used by BMO Harris Bank N.A. FUNDS ON GIFT CARDS ARE NOT FDIC INSURED.

General Terms: Winners are responsible for all taxes, expenses, baggage fees, ground transportation, meals, fees and costs applicable to their respective prize. A winner's right to a prize is non-transferable and may not be assigned. No substitution of prize or election of cash in lieu of prize will be permitted, except in the sole discretion of Sponsor in light of prize unavailability, in which case a prize of equal or greater value will be awarded. Sponsor will issue 1099 tax forms to winner based on prize value.

By participating in this Raffle, entrants agree to be bound by these Rules and all decisions of Sponsor and Sponsor Personnel, which shall be binding and final. Sponsor and its affiliated entities are not responsible for printing, distribution, production, or other errors that may affect the Raffle, its operation, or its integrity, and may rescind, cancel, or revoke this Raffle based on such error and without liability by refunding all tickets purchased. Tickets or receipts that are mutilated, incomplete, defective, altered, illegible, forged or irregular in any way, or not in full compliance with these Official Rules, are void. Entry constitutes permission for Sponsor to use Winner's name and likeness for advertising and/or promotional purposes (except where prohibited by law).

Winners will be notified on or about September 17, 2012. Sponsor will attempt to notify winners based on contact information provided to Sponsor at time of entry. Entrants are solely responsible for providing Sponsor with accurate and updated information. Sponsor, its affiliated entities, and Sponsor Personnel are not responsible for incorrect, incomplete, or illegible contact information provided by entrants. Winners and travel companions may be required to execute an affidavit of eligibility, waiver of liability and publicity release, to be returned to Sponsor prior to travel. In the event that the winners fail to claim any prize or fail to acknowledge acceptance of a prize, the winner's right to the prize may be forfeited. In such event, the prize may be sold and all proceeds will benefit Sponsor.

Each entrant, including each winner, agrees to release and hold harmless Sponsor and Sponsor Personnel from any liability, claims, actions, losses, or damages arising in any way from participation in this Raffle or acceptance, failure to accept, receipt, ownership, use, or misuse of any prize. To the extent that some provisions may not be applicable in whole or in part, the liability of Sponsor, shall be limited to the fullest maximum extent permitted by law, including, where permitted, eliminated altogether. Entrant agrees that (1) under no circumstance will entrant be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses, and (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Raffle, but in no event attorneys' fees.

Sponsor respects your privacy, and entrants' information will not be used except by Sponsor, as otherwise provided in these Rules. The Raffle is subject to the laws of the State ofIllinoisand the Municipal Code of the City ofChicago. Any dispute in connection with these Official Rules or this Raffle shall be resolved exclusively in state or federal courts inChicago,Illinois. Entrants consent to jurisdiction in such courts.
