Official Rules for Mercy Home’s “Have Mercy! Spring Gala” 2012 Raffle

VOID WHERE PROHIBITED.  All raffle tickets must be purchased or issued in the City of Chicago or other authorized jurisdiction.  The Mercy Home “Have Mercy! Spring Gala” 2012 Raffle (“Raffle”) is a random drawing raffle to occur at The Trump International Hotel and Tower, Chicago, IL to be held on or about Saturday, April 21, 2012 (the “Drawing”).  Participation constitutes each entrant’s full and unconditional acceptance of and agreement to be bound by these Official Rules.  Raffle is sponsored by Mercy Home for Boys & Girls, 1140 W. Jackson, Chicago, IL 60607 (“Sponsor”).


Eligibility / To Enter: The Raffle is open to individuals who are at least 21 years of age.  Tickets for the Raffle will cost twenty dollars ($20.00) per ticket or one-hundred dollars ($100.00) for 6 tickets.  To enter, eligible entrants must purchase one or more raffle tickets for the Raffle anytime between April 16, 2012 and April 21, 2012, prior to the Drawing and while supplies last (the “Entry Period”).  Tickets may be purchased during the Entry Period at the Spring Gala or online at www.mercyhome.orgTickets must be purchased or issued in the City of Chicago or other authorized jurisdiction through Sponsor prior to the Drawing and while supplies last.  No more than 500 raffle tickets will be sold.  Employees of Sponsor are not eligible to enter.


Selection of Winners: One (1) Grand Prize winner will be randomly selected in the Drawing.  Winners need not be present at the Drawing to win.  Winners must acknowledge acceptance of their prize to Sponsor by April 27, 2012 or prize may be forfeited.  Odds of winning depend on number of entries; no more than 500 tickets will be sold. 



a.)   Grand Prize winner will receive one (1) prize package consisting of two (2) round-trip Charter/Value air seats to Cancun, Mexico. Travel will be aboard a Funjet Vacations’ Charter/Value Flight departing from Chicago, Illinois compliments of Funjet Vacations; and three nights’ accommodations for two (2) people at a 5-star all-inclusive hotel, compliments of Carol’s Travel Service, Inc.  Travel must be completed by December 15, 2012 or prize will be forfeited in its entirety.  Winner must have a valid US Passport to travel to Mexico.


b.)   To claim your prize package, please carefully read the terms and conditions and mail back the completed form at least 45 days prior to your first choice of travel dates.  Carol’s Travel Service promotions department will contact you via e-mail when your request has been received in their office.  Prize letters received in their office are processed in the order in which they are received.  Requests will be processed within 10 business days.  Space is based on availability and submitting your prize letter 45 days prior to departure allows a greater opportunity to secure your preferred travel dates.  Carol’s Travel Service will begin processing your travel request upon receipt of your original prize letter and the Funjet Vacations Bill of Rights signed and dated by all travelers 21 years of age and older. 


c.)   Please fill in all the information requested, sign and return the Prize Letter (Originals Only) and the Funjet Vacation Bill of Rights to Carol’s Travel Service, Inc.


d.)   Travel will be aboard a Funjet Vacations’ Charter/Value Flight departing from Chicago, Illinois.  Please note A VALID US PASSPORT IS REQUIRED for all international travelFunjet Vacations will not rebook or revise any reservations if travelers do not possess a valid U.S. Passport by their date of departure.  For more information, visit


e.)   Travel must be completed by December 15, 2012


f.)    Reservations will be made in accordance with your 1st, 2nd, and 3rd choices of travel dates listed.


g.)   All travel is SUBJECT TO AVAILABILITY.  Carol’s Travel Service, Inc., and Funjet Vacations reserve the right to change the air or hotel portion of your trip at any time.  Holiday, convention periods and special events are blacked-out for travel.  Holiday blackout dates are 5 days prior and 5 days after each major holiday.  Major holidays are:  New Years, March 1-31 for Spring Break, Easter, Memorial Day, Independence Day, Labor Day, Thanksgiving, and Christmas.  Additional blackout dates may be provided by the hotel.


h.)   Please submit the prize letter 45 days or more prior to your earliest travel date requested. Copies & faxes will not be acceptedONLY THE ORIGINAL PRIZE LETTER WILL BE ACCEPTED.


i.)    Winner must be 21 years of age or older.  Children accompanying winner must be 12 years of age or older when traveling in a promotional seat.


j.)    Applicable taxes and surcharges are not included and must be paid by winner.  Upon receipt of travel confirmation, an email will be sent advising of all applicable taxes and surcharges.  Taxes and fees are subject to change upon notice from Funjet Vacations.  Taxes are non-refundable.  Accepted forms of payment:  credit card, cashiers check or money order.  No personal checks or cash will be accepted.


k.)   Should Funjet Vacations eliminate service to the destination; a comparable destination will be substituted.


l.)    Delay compensation will not be granted to promotional winners.  Prizes are nontransferable and cannot be redeemed for cash.


m.) Winner and companion are required to sign, date and return the enclosed Funjet Vacations Bill of Rights with prize letter.  No additional information is required by Funjet Vacations Bill of Rights other than signature and date.




o.)   These charter air seats are non-transferable, may not be redeemed for cash value nor can it be extended beyond the aforementioned date.  Please note once departure date is confirmed no date changes will be permitted; if winner cannot travel on date confirmed, prize will be forfeited.  Transfer costs, US Air Fees, Fuel Surcharges, Foreign Departure taxes and the purchase of mandatory travel insurance is not included, and are to be paid by the traveler.

p.)   Hotel Nights are non-transferable, non-refundable, and not redeemable for cash and may not be sold.  Travel over holidays and other peak travel periods are restricted.  The winner of this certificate is responsible for paying any resort fees, parking fees, room service charges and any other incidentals assessed directly by the hotel, and/or not directly specified above.  Travel is subject to availability and some restrictions may apply.  Extensions can not be given to this certificate.  A $250 change fee applies to all changes once the itinerary is confirmed; a $200 fee will be charged for all cancellations.


q.)   All travel arrangements must be made by calling Carol’s Travel at 1-708-532-5450.  Carol’s Travel is located at 7625 West 159th Street, Tinley Park, Illinois, 60477.


r.)    Approximate retail value of Grand Prize (“ARV”): $2,800.00 Actual value may vary based on airfare fluctuations.  Winners are responsible for all taxes, expenses, baggage fees, ground transportation, meals, fees and costs applicable to their respective prize.  A winner’s right to a prize is non-transferable and may not be assigned.  No substitution of prize or election of cash in lieu of prize will be permitted.


s.)    Travel Award letters have no value except when redeemed in accordance with the terms and conditions in the prize letter guidelines as well as those listed on the back of the prize letter. Tickets are not transferable or refundable.


t.)    Travel awards provided can not be bartered or sold for cash, or in lieu of cash payment. 


u.)   Travel awards can not be used for a fundraising activity conducted by or in connection with a 3rd party (including, but not limited to the offering of Travel Awards on public auction web sites such as eBay).


General Terms:  By participating in this Raffle, entrants agree to be bound by these Rules and all decisions of Sponsor, which shall be binding and final.  Sponsor and its affiliated entities are not responsible for printing, distribution, production, or other errors that may affect the Raffle, its operation, or its integrity, and may rescind, cancel, or revoke this Raffle based on such error and without liability by refunding all tickets purchased.  Tickets or receipts that are mutilated, incomplete, defective, altered, illegible, forged or irregular in any way, or not in full compliance with these Official Rules, are void.  Entry constitutes permission for Sponsor to use Winner’s name and likeness for advertising and/or promotional purposes (except where prohibited by law).  


Winners will be notified on or about April 23, 2012.  Sponsor will attempt to notify winners based on contact information provided by each winner to Sponsor at time of entry.  Entrants are solely responsible for providing Sponsor with accurate and updated information.  Sponsor, its affiliated entities, and Sponsor Personnel are not responsible for incorrect, incomplete, or illegible contact information provided by entrants.  Winners and travel companions may be required to execute an affidavit of eligibility, waiver of liability and publicity release.  In the event that the winners fail to claim any prize or fail to acknowledge acceptance of a prize, the winner’s right to the prize may be forfeited.  In such event, the prize will be sold and all proceeds will benefit Sponsor.


Each entrant, including each winner, agrees to release and hold harmless Sponsor from any liability, claims, actions, losses, or damages arising in any way from participation in this Raffle or acceptance, failure to accept, receipt, ownership, use, or misuse of any prize.  To the extent that some provisions may not be applicable in whole or in part, the liability of Sponsor shall be limited to the fullest maximum extent permitted by law, including, where permitted, eliminated altogether.  Entrant agrees that (1) under no circumstance will entrant be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses, and (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Raffle, but in no event attorneys’ fees.


Sponsor respects your privacy, and entrants’ information will not be used except by Sponsor, as otherwise provided in these Rules.  The Raffle is subject to the laws of the State of Illinois and the Municipal Code of the City of Chicago.  Any dispute in connection with these Official Rules or this Raffle shall be resolved exclusively in state or federal courts in Chicago, Illinois.  Entrants consent to jurisdiction in such courts.
